Assisted Living waiver facilities
I want to see my mother’s records at the assisted living home, they want me to sign a waiver and nurse with me?
My parent is at Senior Star at Elmore Place in Iowa and the facility is having major problems. I want to see her records and they say I have to sign a waiver and have the Assisted Living Director with me as I review it. Is this legal?
Yes, they’re legally bound to keep medical records confidential. You should find out who is on her list as the power of attorney (usually a spouse or another family member) and talk with them about getting access to the records. The part about them having someone there protects them against the person reviewing the records from removing anything from her file, but they shouldn’t be breathing down your neck while you’re reviewing the files. As another suggested, wouldn’t hurt to consult a lawyer who specializes in this kind of thing.
